1. Eligibility: iPad 2 Sweepstakes (the "Promotion") is open only to legal residents of the United States and the District of Columbia who are at least eighteen (18) years old at the time of entry.  Employees of Dole Nutrition Institute, The Nutrition Post, and any of their parent and affiliate companies, as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. This promotion is subject to all applicable federal, state, and local laws and regulations and is void in Puerto Rico and where prohibited.

4. Agreement to Official Rules: Participation in this Promotion constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to this Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein.

 

5. Timing: The Promotion begins on January 1, 2012 at 12:00 a.m. Eastern Time ("ET"), ends on June 30, 2012 at 11:59 p.m. ET (the “Promotion Period”).

 

6. How to Enter: Please visit http://www.thenutritionpost.com and follow the links and instructions to complete and submit the registration form, including a valid home mailing address. P.O. Boxes are not permitted.  After submitting the form, you will automatically receive an email that will give you further instructions on completing your registration. After you have completed your registration process, you are automatically entered for a chance to win a FREE iPad 2 beginning January 1, 2012.

 

7. Selection of Promotion Winners/Odds: The potential winner will be selected in a random drawing to be held beginning July 1, 2012 at 12:00 a.m. Eastern Time ("ET"),which is the 1^st day following the end of the promotion period. One winner will be selected by July 10, 2012 at 11:59 pm. Eastern Time ("ET"). Winner will be selected from entries received during the Promotion Period. Odds of winning will depend on the number of eligible entries received during the Promotion Period. The potential winner will be notified via email at the email address submitted with the potential winner’s entry after the selection period ends. The drawing will be conducted by Sponsor, the judge of the Promotion, whose decisions on all matters relating to the Promotion shall be final and binding. In the event that a potential winner is disqualified for any reason, Sponsor may, in its sole discretion, award the applicable prize to an alternate winner selected at random. Any return of prize notification or prize email as undeliverable will result in forfeiture of any prize and an alternate winner may, at Sponsor's discretion, be randomly selected.

 

8. Prizes: One (1) Free iPad 2 (16GB) with a total approximate retail value of $499.00. Prizes will not be replaced if lost or stolen, are not transferable and are not redeemable for cash. No substitutions allowed

 

9. Limitations of Liability: By participating in the Promotion, entrants agree to abide by the terms of these official rules and the decisions of the judges, waive any right to claim ambiguity in the rules, and release, indemnify and hold harmless the sponsor, Dole Nutrition Institute and each of their, affiliates, subsidiaries and their respective agents, representatives, officers, directors, shareholders and employees (collectively, "releases") from and against any injuries, losses, damages, claims, actions, or any liability of any kind resulting from or arising from participation in the Promotion, or acceptance, possession, use, misuse or nonuse of the prize that may be awarded, or by an event of force majeure or any occurrence beyond the reasonable control of the party and without its fault or negligence such as acts of god, actions by any governmental authority, fires, floods, windstorms, explosions, riots, natural disasters, wars, labor problems, inability to obtain power, failures to connect to the internet, network or electric failures, material, labor equipment or transportation. Entrants agree that any and all disputes shall be governed by the laws of the state of California. Winners agree to accept the prize "as is", and entrants hereby acknowledge that sponsor has neither made nor is in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the prize. Releases are not responsible for printing or typographical errors in any Promotion related materials; or for transactions that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, mail system, human or other error; or for electronic, computer, or telephonic malfunction or error, access any web site associated with this Promotion, or process any transaction thereon.
    
    If in the sponsor's opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Promotion, or if computer virus, bugs, unauthorized intervention, increased web site traffic, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, stability, fairness, or proper conduct of the Promotion and/or any web site associated with the Promotion, sponsor reserves the right in its sole and exclusive discretion to disqualify any individual who tampers with the entry process and or void any entries submitted fraudulently, to modify or suspend the Promotion, or to terminate the Promotion and conduct a random drawing to award the remaining prizes using all eligible, non-suspect entries received as of the termination date. Sponsor reserves the right to modify or terminate the Promotion in its entirety at any time and at its sole discretion. Should the Promotion be terminated or modified prior to the stated expiration date, notice will be posted on http://thenutritionpost.com. Any attempt by an entrant or any other individual to deliberately damage any web site or undermine the legitimate operation of the Promotion is a violation of criminal and civil laws and should such an attempt be made, the sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.
   
    Any attempts by an individual to access any web site associated with this Promotion via a bot script or other brute force attack or any other unauthorized means will result in the person and IP address becoming ineligible. Use of automated entry devices or programs is prohibited.
